Online reservations require full payment upon booking, and are non-refundable. This website is designed to provide you with information regarding the hotels which make up the Occidental Hotels & Resorts Group (Occidental), whether owned, managed, leased, franchised or associated, as well as the products and services offered and provided by Occidental from time to time.

(i)Use of this website gives you status of user (User), which implies acceptance of these conditions as published at the time when you access it. Status of User requires you not to use the contents made available to you through this website for illegal activities. Users are liable for those damages Occidental may suffer as a consequence of the breach of any of the obligations they are subject to under these conditions.

(ii) Any use of this website counter to or in infringement of these conditions is strictly prohibited. Occidental is thus authorized to refuse access to this website to Users who breach these conditions. These conditions are subject to changes and modifications at any time. Therefore, Users should read these conditions periodically, whenever accessing this website.

(iii) The information contained in this website (the Information) is current on the date of its latest update and must be considered introductory for the User in relation to the products and services and other information contained in this website, without any form of express or implied guarantees. Users can confirm the date of update of the Information by requesting it at the e-mail address available on this website. Any liability which may arise from the commercial content and commercial or other services from websites which may be electronically linked, directly or indirectly, through this website, is expressly excluded. Accordingly, Occidental does not guarantee the reliability, availability or continuity of its website or its contents, so that their utilization by Users is for Users own account and risk. No claim may be made against Occidental in this sense at any time. Likewise, Occidental accepts no liability for possible service outages, delays, errors, malfunctions and, in general, any other inconveniences originating in causes beyond its control, due to User actions, and/or arising from Force Majeure as defined in the Spanish legal provisions and jurisprudence. In any event, whatever the cause, Occidental assumes no responsibility whatsoever for direct or indirect damages, consequential damages and/or loss of profits. Occidental may temporarily suspend the website services and content for maintenance, upgrading or repairs to it, without any indemnification to Users for these items.

(vi) Occidental hereby excludes and declines any responsibility which may arise from the transmission of data between Users, or their declarations on its website, and assumes no responsibility for reasons of technical problems or mechanical failures in the computer equipment which arise during connection to the Internet. Occidental is also hereby released from any liability arising from the transmission of computer viruses or from damage caused by third parties who interact through this website without authorization.

(vii) The personal data the User provides on admission to any of the services offered on this website may be incorporated into existing Occidental computerized files. In compliance with the terms of the applicable regulations, prior to collection of the Users personal data, they will be advised of the existence of that file and its purpose, the rights of access, correction and cancellation, the name and address of the person responsible for the processing, and other legal requirements. Occidental thereby guarantees compliance with Organic Law 15/99, dated 13th of December, on Personal Data Protection.

(viii) The content of this website, including images, texts, designs, animations or any other content or elements, specifically developed software and codes in JAVA, JAVA Script, HTML or Active X or other languages, is the property of Occidental. Copying, use, reproduction, distribution or any form of communication of the Information and other elements appearing on the website is strictly prohibited, as is their distribution, modification, alteration or decompiling. Nonetheless, that prohibition does not apply to wholesalers and retailers and other suppliers who ask Occidental in advance for the pertinent authorization, provided that such authorization is granted expressly and in writing by Occidental.

(ix) Hotel reservations made by User through this website are not guaranteed if the credit card data provided in making such reservation were not correct.

(x) These conditions are governed by Spanish law. Therefore, should Users be in a country whose regulations limit access to websites with the characteristics of that of Occidental, they will not be authorized to access the contents of this one. Occidental and the User hereby expressly relinquish any venue which may be available to them and irrevocably submit to the Courts of the City of Madrid (Spain) for the purposes of any dispute arising out of these conditions or this website.

(xi) The images corresponding to the Occidental Hotels & Resorts destinations may not be reproduced for any reason. CUSTOMER TRAVEL & PAYMENT: Terms & Conditions

PROOF OF CITIZENSHIP WITH VALID UNITED STATES PASSPORT is required for travel. Effective January 23, 2007 the U.S. Government introduced new passport rules that require all travelers to and from the Caribbean, Mexico, Central and South America to travel with a valid passport. For information on obtaining or renewing a passport visit your local United States Post Office at www.usps.com or http://travel.state.gov/passport/index.html. Knowledge and acquisition of valid travel documentation is the sole responsibility of each traveler.

DEPOSIT, CANCELLATION & REFUND POLICIES:

NON-HOLIDAY TRAVEL PERIOD: February 24, 2008 to Dececember 21, 2008: Online bookings must PAID IN FULL at time of booking and are NON-REFUNDABLE.

FOR CALL CENTER RESERVATIONS: A NON-REFUNDABLE deposit of $200 per person is required within 7 days of booking your reservation. Reservations must be paid in full 45 days prior to travel. If reservation is made inside 45 days of travel, reservation must be paid in full for all travel components at time of booking. Reservations become NON-REFUNDABLE after full payment and/or 45 days prior to travel.

CHANGE FEES will apply at $25 per person for land-only packages if made between 45 and 15 days to departure. If changes are made within 14 days of travel, $100 per person penalty change fee applies. Rates are based on availability and subject to rate increases/decreases.

AIR FARES: If Published or Sale Fare tickets are booked, the full cost of the airfare is due with the initial deposit and is immediately non-refundable. Note: airlines reserve right to change air schedules, add fuel surcharges and taxes. Please note: E-Tickets will NOT be mailed via United States Post unless guests are traveling with an infant.

HOLIDAY TRAVEL PERIOD: (December 21, 2007 - January 2, 2008) & Presidents Day (February 16 - 23, 2008) Policy: A $400 NON-REFUNDABLE deposit per person plus air (if air is booked) is required within 7 days of booking your reservation. Balance is due 60 days prior to travel. CHANGE FEES will apply at $100 per person for land-only packages if made outside of 30 days prior to travel. No changes can be made inside 30 days of travel. Reservations become NON-REFUNDABLE after full payment and/or 60 days prior to travel. Reservation becomes NON-REFUNDABLE after full payment and/or 60 days prior to travel.

Note: Arrivals starting January 2, 2008 will not follow the Holiday policy. The regular deposit, cancellation and refund policy will apply.
